Careful what you wish for!


Imagine my surprise when I logged into my personal Facebook account and the first item on my “news feed” was from my friends at the Handmade Toy Alliance encouraging people to call their Representative in support of the Waxman proposal to “fix” the CPSIA!

Even CPSC staff has expressed concern that the small batch provisions will require the Commission to approve any “alternative” test methods on a product by product, rule by rule, basis (How long will HTA members wait on the Commission for all these new regulations?)…and there’s a degree of uncertainty about what an alternative test could even mean (and will it “assure compliance”?) ...and of course, a majority of Commissioners likely will have to vote to approve each of these alternative test methods (can anyone read the tea leaves on those votes?)…

Turns out, it may not be the gift you were wishing for...

Anne, we are not urging our members to "to call their Representative in support of the Waxman proposal to 'fix' the CPSIA." We are very aware of the limited scope of relief the CPSEA offers us and we stand by our April 29 testimony about what we'd like to see changed. As was highlighted in the hearing, it would be useful to understand what the CPSC envisions the meaning of "alternative testing method" to be ahead of time. But, we are willing to believe that the commission can work with us to find a common sense approach to this concern.

What we are calling for is for Democrats and Republicans to work together in open committee to make this a truly bipartisan bill. We feel that if both sides of the aisle can actually work together on this, we may be able to achieve meaningful reform. Failing that, we continue to feel that the CPSEA as drafted is our only chance to keep our businesses alive past 2/10/11. We have yet to see any Plan B from Congress or the CPSC.
